                              July 13, 2011

A regular monthly meeting of the Town of Winter Board of Supervisors
was called to order on July 13, 2011 at 7:00 PM by Chairman James
Genrich with supervisors Helen Dennis and David Kinsley, clerk Lori
Van Winkle and 15 citizens in attendance.  Chairman Genrich welcomed
everyone and the pledge of allegiance was recited.

A motion was made by David Kinsley, seconded by Helen Dennis to
approve the agenda, motion carried.

Regarding approval of the June 9, 2011 meeting minutes, David Kinsley
asked that we correct the last paragraph last sentence to read his
opinion instead of their opinion, clerk noted the correction.  A
motion was made by Helen Dennis, seconded by David Kinsley to approve
the meeting minutes of June 9, 2011 with the correction.

Disbursements were reviewed.  A motion was made by Helen Dennis,
seconded by David Kinsley to approve the disbursements. 

A request to transfer Liquor License from TePaskes Big Bear Lodge to
new owners Verbskys has been done; they also applied and paid for a
cigarette license.

Operatorís license applications were read by the clerk, David Kinsley
asked if background checks were done, they were and were all
satisfactory.  A motion was made by Helen Dennis, seconded by David
Kinsley to approve the operator licenses, motion carried.

A conditional use permit for Haystack Gravel Pit is up for renewal,
weíve completed the necessary paperwork for the renewal and itís on
the agenda for Friday July 15, 2011 at a Public Hearing in Hayward,
WI.  At this time we are using the pit for storage of gravel but would
like to keep it for future use when needed.  A motion was made by
David Kinsley, seconded by Helen Dennis to approve the application for
permit renewal to keep Haystack pit operational.  Motion carried.

Special Use Permit AG1 for Thomas and Ronnell Nelson has been received
from county zoning for approval by the Town.  The information has been
reviewed and location has been inspected and meets requirements.    A
motion was made by Helen Dennis, seconded by David Kinsley to approve
the permit, motion carried.

At our June 9, 2011 monthly meeting we a Special Use Building Permit
for Cade Clark requesting a zoning change from AG1 to Residential was
discussed and postponed, after further review it was advised that the
owner remain at AG1 as it is acceptable to construct a building in AG1
as long as there are 5 or more acres.   Warren Johnson explained the
reason the county sends these to the town now is to speed things up
for the owner.  Previously the owner had a 60 day process to go
through before their permit would be approved.  The county would hold
a hearing etc and they never turned any down. It made more sense to
change the process.  If itís Forestry land or Agricultural land with 5
or more acres it is acceptable to build on, so they send these to the
town asking if the town has any objections, if there are objections
the county will still go through the process.  If there are no
objections, the town approves it and so does the county and it
eliminates the 60 day waiting and a hearing etc.

The current Town ordinance dated June 15, 1999 related to driveway
specifications has been reviewed.  There are many driveways in our
township that do not meet the specifications required in the
ordinance.  Many are properties that have changed ownership over the
years and many may not be aware of the driveway ordinance.  The main
concern is that should these properties require emergency vehicles to
enter, the driveways are not adequate to receive these vehicles which
could delay or make it impossible to receive emergency services.  
Fire trucks in particular, with all the equipment and ladders are
quite high.   The board would like to inform property owners of the
ordinance specifications so property owners can make the improvements
to the driveways for emergency vehicle access.  A suggestion is to
publish a notice in the local newspaper to inform owners and also
enclose a notice with their property tax statements.

Rock is needed on South Clover Road for the ditch line on the hills on
the road.  Dennis Lowers a resident on South Clover Road has numerous
rock piles on his property that are ideal for our road project.  He
would like the rock piles removed and has offered to sell the rock to
the town for $3.75 per yard, which is an excellent price.  The town
needs approximately 30 loads of rock.  Currently these type of rock
costs are running between $25.00 and $30.00 per yard.  The only other
cost involved will be for trucking, which will be minimal with the
location right there on South Clover Road.  A contract has been
prepared to purchase this rock.   A motion was made by David Kinsley,
seconded by Helen Dennis to approve the contract to purchase rock from
Dennis Lowers at $3.75 per yard.  Motion carried.

The Paser Road Rating Contract through Northwest Regional Planning
Commission was discussed.  A gentleman from NW Regional Planning
Commission who is very familiar with the process will do all the
evaluations of the town roads, all paperwork and proper filings with
the DOT, and provides the town colored maps, the cost is $1437.00
annually.  It would be more cost effective to contract with NW
Regional Planning Commission for this rather than pulling our crew
members from town work to do this.  This is done every odd year, the
last one was done in 2009 and Paser Road Rating was used at that time.
 Helen Dennis asked if they can include the counting of our signs, an
inquiry will be made to add counting of signs if possible.  A motion
was made by Helen Dennis, seconded by David Kinsley to approve the
Paser Road Rating Contract through Northwest Regional Planning

Work has been done on Ehn Road and once the Power company completes
their work, the Town will be back to finish it up.  Currently we are
working on South Clover Road from 70 west to north approximately 3
miles.  Permits have been approved from the DNR and Army Corps of
Engineers approving the rip rap on the Brunet River and culverts etc. 
Completion should be by the end of the month.

Helen Dennis mentioned that in their discussions with the DNR, they
want the town to do some crushing, but before they bring a crusher in
would like to determine a specified amount to be crushed, they
mentioned 2000 yards which can be used on West Lane.  Chairman Genrich
will contact the DNR for confirmation.

The Beaver problem on West Lane has been resolved by the Animal
Nuisance Control people and things are back to normal.

Open Book is scheduled for July 20, 2011 10:00 am to 1:00 pm and Board
of Review July 26, 2011 beginning at 6:00 pm.  Chairman Genrich
reported that all four board members are certified for Board of

Lowering the speed limit to 45 mph has been suggested for West Lane (a
gravel road) due to the various vehicles and traffic.  There is ATV
traffic, logging truck traffic and increased automobile traffic for
people traveling down for canoeing.  ATVs have a speed limit,
automobiles and Logging Trucks can travel at 55 mph, which has created
issues for all vehicle use and safety.  There may have to be a study
done and or a hearing for all vehicles operators involved, to voice
their opinions regarding this before the speed limit can be changed.

An ADS Fishing dock has been installed on Lake Winter on June 29,
2011, with many positive comments from the public.  The dock is well
constructed with aluminum and composite material and stainless steel
bolts and the size is the same as the previous dock 8 x 24.  It will
be pulled from the water during the winter months and should last many
years.  A gate has been installed that is opened at 6:00 am and closed
at 10:00 pm and signs posted with rules of use and that all dogs must
be on leashes.  Courtney Bates is currently the gate keeper opening
and closing the gate and cleaning up any garbage in the area.  A
question was asked if we received a grant to purchase the dock.  We
did inquire about a grant and received the paperwork.  Current grants
are one and a half to two years out and have become much more
difficult to obtain because of the numerous other organizations
involved in the process.  Itís not just completing paperwork anymore,
itís actually working with these groups individually and when all is
done, there are no guarantees of the grant, at this time a grant was
not received.  The dock cost was $14,750.00.  The current litigation
related to the dock has not been resolved.  The board is sensitive to
the concerns; mainly liability and we have taken numerous measures to
maintain a safe environment at the dock location.  A tentative date
for a decision on the case is August 21, 2011.  Alternate site
locations are being reviewed in the event the litigation is not in the
Towns favor.  

Lynn Johnson asked about the signs at Price Dam that state all dogs
must be on a leash, does this mean dogs canít go down there to swim?? 
Helen Dennis explained that families with small children fish from the
A situation occurred where a little girl was fishing on the dock,
another group of people let their dogs out and one of the dogs ran
onto the dock and knocked the little girl off the dock into the lake,
thankfully, no injuries occurred.  The signs are a reminder and an
effort to get people to use common sense in these situations.  If
there are no people around, no one fishing from the dock then it
wouldnít be a problem to allow dogs to go free for a swim, but if
there are people around and fishing from the dock, dogs should be
controlled by their owners to avoid any problems, we just want people
to use common sense and keep everyone safe.

The treasurers bond is up for renewal.  Itís a three year bond and the
premium is $510.00. The Bond covers the treasurer and deputy treasurer
for $50,000.00 each. The bond has been renewed.

Chairman Genrich opened the floor to the public, there being no
further business to discuss, the next meeting date was set for August
10, 2011.

A motion was made by David Kinsley, seconded by Helen Dennis to
adjourn this meeting, motion carried.
