TOWN OF WINTER

Monthly Meeting                                                       
                          October 12, 2011


A regular monthly meeting of the Town of Winter Board of Supervisors
was called to order on October 12, 2011 at 7:00 p.m. by Chairman James
Genrich, Present were Supervisors David Kinsley and Helen Dennis,
clerk Lori Van Winkle and 21 citizens. Chairman Genrich welcomed
everyone; the pledge of allegiance was recited.  Chairman Genrich made
a change in the agenda order, moving audience recognition after guest
speakers.  A motion was made by David Kinsley, seconded by Helen
Dennis to approve the agenda change, motion carried.  A motion was

Sheriff Mark Kelsey was introduced and given the floor for a question
and answer time.  Sheriff Kelsey encouraged people to always call them
even if it seems small, call anyway, their department can be much more
effective if they are made aware of issues.  

Pat Sanchez from Search and Rescue and Chief Deputy Bridget Kornbroke
then gave a presentation for Project Lifesaver and demonstrated how
the unit works for tracking people who are lost.  This program has
been used for people with Alzheimer’s and Autism by wearing a
transmitter and if they should wander away and become lost, the
receivers can help identify their location.  Through a grant the
Sheriffs Department received two transmitters and two receivers were
purchased; however, to be most effective a third receiver is needed to
triangulate the location of the lost person.  There are people in our
area that would benefit from this program, however, cannot afford the
units.  The cost of the receivers are approximately $800.00 and the
transmitters approximately $300.00.  They are seeking donations to
purchase additional transmitters and receivers. A show of hands
indicated that the majority of the audience is in favor of supporting
this program.

A motion was made by David Kinsley, seconded by Helen Dennis to
approve the meeting minutes from September 14, 2011, September 26,
2011 and October 4, 2011, motion carried.

A public hearing will be held on October 21, 2011 at the Courthouse to
approve the Gravel Pit Permit for the Flambeau River State Forest. 
The Town of Cedar Rapids and Town of Winter would like to use this
pit.  A motion was made by Helen Dennis, seconded by David Kinsley to
approve the permit for the Flambeau River State Forest gravel pit,
motion carried.  Chairman Genrich stated that once the permit is
approved, the town of Winter will be hauling approximately 4000 yards
of gravel for the Town of Cedar Rapids onto West Lane which will take
place the end of October.

Road report was given by Chairman Genrich.  South/North Clover Road is
near completion, hills cut down, culverts installed, grading done,
still have to gravel the road for blacktopping in the spring.  Old Hwy
70, culverts are being installed and preparing road for blacktopping
for next year.  Pine Road & Perch Lake Road are small roads that will
be blacktopped soon.  Lake Winter Road, Tower Road and Universal Road
have been scheduled for blacktop (Patch) overlays due to breakup from
last spring.  Total Cost is approximately $78,000.00 for the roads
mentioned.  Monarch does the actual paving of the roads.  Keehn road
has a small section at the intersection that will be patched also.

A question was asked how the roads were damaged; Chairman Genrich
stated we will be contacting companies, for example, Waste Management,
Septic Trucks, Gas Trucks etc in January to inform them of road
restrictions that will take place in March to eliminate these heavy
trucks damaging our roads.

Chairman Genrich expressed a Big Thanks to Chuck Kelly and Helen
Dennis who painted the lower portion of the meeting room of the town
hall.

Agenda item # 11 – a. New Front End loader has been postponed to our
special meeting on Tuesday, October 18, 2011 at 10:30 am.

Jerome Martin, president of the Winter Cemetery association stated
Pursuant to Wis. Statute 157.052 they are requesting a raise in the
tax levy for the cemetery for 2012 in the amount of $1000.00, from
$3000.00 to $4000.00 for the Town of Winter.  There hasn’t been an
increase since 2007.  They are also requesting increases from the Town
of Ojibwa and the Village of Winter.  They are in need of a tractor
and mower.   It is probable that the Catholic Church portion of the
cemetery will be turned over to the cemetery association next year
which will increase costs of maintenance.  Jerome stated they are
working on a very tight budget, 2010 revenues were $7,657.00 and
expenses were $7163.62, leaving a surplus of only $500.00. With these
increases for each municipality, it will help with the cost of new
equipment.  The board will take action on this request at our budget
meeting.

State Statute is very clear regarding a Town Boards authority for
paying bills without having disbursements approved prior to paying
them.  By implementing an Alternative Claims Procedure, pursuant to
Wis. Stats. 60.44(2) it allows us to pay recurrent bills such as
payroll, utilities etc under this alternative claims procedure.  We
have not found an existing ordinance related to this, to be in
compliance we are asking for approval of an alternative claims
procedure, a motion was made by David Kinsley, seconded by Helen
Dennis to approve the alternative claims procedure ordinance #2011-2,
motion carried.

The last payment for 2011 to the Fire Department has been paid in the
amount of $24,841.53.

The Town is updating and seeking people to develop a roster of
election workers for 2012.  Training is required; please contact Lori
at the town hall if interested.

Warren Johnson, county supervisor was given the floor, he said they’ve
been working on the county budget stating this is the third year in a
row the levy has remained the same as the previous year which will
result in a little decrease for the Town of Winter because our
equalized tax valuation has decreased a little more than the rest of
the county.  Jail Bonds are being refinanced with a savings of over
$200,000.00.  Since the return is so little on surplus monies in the
bank, they are also looking to use some of their surplus monies for
early payoff on some things, as long as the funds are available it
makes sense to do this and it will increase their yield to around 10%.
 David Kinsley asked Warren if the county has any surplus funds that
could be used for the Project Life Saver program.  Warren states that
he was very surprised that this had not come before the county, to
Health and Human Services which is the committee of jurisdiction, they
meet next Tuesday and Warren will ask them about it.   He encouraged
the town to contact the county related to the loggers who have caused
damage to ditches and roads as Loggers are required to carry a bond
and they will not be paid until things are satisfactory.  Warren was
asked related to the Project Life Saver Program, if the Town should
wait until they hear from him whether the county will be assisting in
the program before the Town acts on it?  Warren stated he felt it was
a good program and perhaps both should act.  A question was asked
regarding zoning and sanitation; does Sawyer County still have a 35’
setback from the ordinary high water mark? (The buffer zone where you
are not allowed to build in or disturb) Warren responded to contact
Zoning.  The citizen had and Zonings response allows a Holding Tank to
be placed within 10’of the ordinary high water mark, which does not
make any sense and asked where the justification is with this? In the
35’ buffer zone you are not allowed to even cut a tree, but it’s ok to
dig a hole and place a holding tank?  Warren replied that if you’ve
addressed it with zoning, their response is the answer. 

 A motion was made by Helen Dennis, seconded by David Kinsley to
approve the disbursements as presented, motion carried.

Jerome Martin asked to explain Barry Fliess expenses for cemetery
maintenance to everyone.  Chairman Genrich explained the process that
the Town pays Barry and at the end of the year the cemetery
association reimburses the town for his expenses.

A citizen commented that if a special meeting is not an emergency
meeting although they have been properly posted at the various
locations etc he felt we should plan it accordingly so it can also be
published in the paper so the public doesn’t feel we are shutting them
out of special meetings.  Chairman Genrich stated we will make every
attempt to see that they are also published in the paper.

There was no further business to discuss.  Next meeting date was set
for November 9th, 2011.  Chairman Genrich thanked everyone for
attending and for their input.  

A motion was made by Helen Dennis, seconded by David Kinsley to
