An Ordinance Designating a Portion of County Road W as ATV Route

 

STATE OF WISCONSIN

Town of Winter

Sawyer County

 

I.  Purpose

            The purpose of this ordinance is to designate a portion of County Road W, located in the Town of Winter as an all-terrain vehicle route to allow access to trails; and to regulate the operation of all-terrain vehicles on that route. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Routes

            The following portion of County Road W is hereby designated as All-Terrain Vehicle route as authorized by s. 23.33(8)(b), WI Stats :

 

            Commencing from the intersection with West Lane and County Road W

            In Section 16 and 17, Township 38 North, Range 3 West,  traveling south

            on County Road W to the ATV trailhead on the south side of the Flambeau

             River bridge, a distance of approximately one half mile.

           

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

 

IV.  Release of Liability

            The Town of Winter shall not be responsible for accidents and/or injuries incurred

while operating an all-terrain vehicle on any designated route.

 

V.  Regulation

            The Town of Winter regulates the operation of all-terrain vehicles on designated routes as follows:

            a.  All all-terrain vehicle operators shall ride single file on the far right of the

            paved surface of the road.

 

            b.  All all-terrain vehicle operators shall observe and obey posted speed limits

            and shall slow the all-terrain vehicle to 10 mph or less when operating within

            150 feet of a residence.  The speed limit for ATVs traveling on designated

            routes is 20 mph unless otherwise posted.

 

            c.   All all-terrain vehicle operators shall have their headlights and tail lights         turned   on at all times.

 

            d.  All all-terrain vehicle operators and riders under the age of 18 must wear a

            helmet.

 

VI.  Enforcement 

                        This ordinance shall be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.

 

VII.  Penalties

                        Wisconsin State All-terrain vehicle penalties as found in s. 23.33(13)(a) WI Stats, are adopted by reference.

 

IX.  Severability

            The provisions of this ordinance shall be deemed severable and it is expressly declared that the Town of Winter would have passed the other provisions of this ordinance irrespective of whether or not one or more provisions may be declared invalid.  If any provision of this ordinance or the application to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provisions to other persons circumstances shall not be deemed effected. 

 

X.  Effective Date

            This ordinance becomes effective upon passage and publication as required by law and the proper signing of all routes as required by this ordinance.

An Ordinance Designating Old Lodge Lane as ATV Route

 

STATE OF WISCONSIN

Town of Winter

Sawyer County

 

I.  Purpose

            The purpose of this ordinance is to designate Old Lodge Lane, a Town of Winter road, as an all-terrain vehicle route, and to regulate the operation of all-terrain vehicles on that route. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Route

 

            Old Lodge Lane  located in the Southeast Quarter of  the Southeast Quarter of Section 22, Township 38 North Range 3 West, is hereby designated as All-Terrain Vehicle route as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:  beginning at the intersection of Old Lodge Lane and County Road M and traveling west four tenths of a mile to the end of the Town Road.

 

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

 

IV.  Release of Liability

            The Town of Winter shall not be responsible for accidents and/or injuries incurred

while operating an all-terrain vehicle on any designated route.

 

V.  Regulation

            The Town of Winter regulates the operation of all-terrain vehicles on designated routes as follows:

           

            (a) All all-terrain vehicle operators shall ride single file on the far right of the

            traveled surface of the road.

 

            (b) All all-terrain vehicle operators shall observe and obey posted speed limits

            and shall slow the all-terrain vehicle to 10 mph or less when operating within

An Ordinance Designating West Lane as ATV Route

 

STATE OF WISCONSIN

Town of Winter

I.  Purpose

            The purpose of this ordinance is to designate West Lane, a Town of Winter road, as an all-terrain vehicle route, and to regulate the operation of all-terrain vehicles on that route. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Route

 

            West Lane is hereby designated as All-Terrain Vehicle route as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:  beginning at the Rusk County line in Section Thirty-three, Township Thirty-seven, Range Four, and traveling north and east approximately twelve miles through Townships Thirty-seven, Range Four; Thirty-eight, Range Four; and Thirty-eight, Range Three to the intersection with County Road W in Section Seventeen, Range Three.

 

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

 

IV.  Release of Liability

            The Town of Winter shall not be responsible for accidents and/or injuries incurred

while operating an all-terrain vehicle on any designated route.

An Ordinance Designating Certain Town Roads as ATV Routes

 

STATE OF WISCONSIN

Town of Winter

Sawyer County

 

I.  Purpose

            The purpose of this ordinance is to designate Lagoon Road, Nelson Road and Kalow Road, all Town of Winter roads, as an all-terrain vehicle routes, and to regulate the operation of all-terrain vehicles on those routes. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Routes

The following roads are hereby designated as All-Terrain Vehicle routes as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:

             

            (a) Lagoon Road:  beginning in Section 4, Township 38 North, Range 5 West at the intersection with County Road W and traveling east approximately ¾ mile to the intersection with Nelson Road, thence south to the end.

            (b) Nelson Road:  beginning in Section 4, Township 38 North, Range 5 West at the intersection of Lagoon Road and traveling east and north to the end.

            (c) Kalow Road:  beginning in Section 4, Township 38 North, Range 5 West at the intersection with Nelson Road and running west to the end.

           

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

Ordinance 2009-10

Adoption of Wisconsin Uniform Dwelling Code

 

Town of Winter

County of Sawyer

State of Wisconsin

 

I.  AUTHORITY

These regulations are adopted under the authority granted by s. 10.65, WI Stats

 

II.  PURPOSE

The purpose of this ordinance is to promote the general health, safety and welfare and to maintain required local uniformity with the administrative and technical requirements of the Wisconsin Uniform Dwelling Code.

 

III. SCOPE

The scope of this ordinance includes the construction and inspection of one and two family dwellings built since June 1, 1980.

 

IV. WISCONSIN UNIFORM DWELLING CODE ADOPTED

The Wisconsin Uniform Dwelling Code, Chs Comm 20-25 of the Wisconsin Administrative Code, and all amendment thereto, is adopted and incorporated by reference and shall apply to all buildings within the scope of this ordinance. 

 

V.  BUILDING INSPECTOR

There is hereby created the position of Building Inspector, who shall administer and enforce this ordinance and shall be certified by the Division of Safety & Buildings, as specified by Wisconsin Statutes, Section 101.66(2), in the category of Uniform Dwelling Code Construction Inspector.  Additionally, this or other assistant inspectors shall possess the certification categories of UDC HVAC, UDC Electrical and UDC Plumbing.

 

 

VI. BUILDING PERMIT REQUIRED

Any person altering a building in excess of $125,000 value in any twelve month period, adding onto a building in excess of $250,000, in any twelve month period, or constructing or installing a new building within the scope of this ordinance shall first obtain a WI UDC building permit for such work from the Building Inspector.  Any structural changes or major changes to mechanical systems that involve extensions shall require permits if over the foregoing thresholds.  Restoration or repair of an installation to its previous code-compliant condition as determined by the building inspector shall be exempted from permit requirements.    Residing, re-roofing, finishing of interior surfaces and installation of cabinetry shall be exempted from permit requirements. (Note:  Land Use permits from Sawyer County Zoning Administration may also be required.)

 

 

 

VII. BUILDING PERMIT FEE

Inspection fees shall be determined by and paid to the UDC certified building inspector contracted to the Town of Winter, and shall include $30.00 or current amount determined by the Department of Commerce,  to be forwarded to the Wisconsin Department of Commerce for a UDC permit seal that shall be assigned to any new dwelling. 

 

VIII. PENALTIES.

The enforcement of this section and all other laws and ordinances relating to building shall be by means of the withholding of building permits, imposition of forfeitures and injunctive action.  Forfeiture amounts shall be set and regulated by Sawyer County Zoning Administration.

 

IX. EFFECTIVE DATE.

This ordinance shall be effective upon passage and publication as provided by law.

 

X.  The building inspector shall keep a log of all inspections completed.

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Routes

The following roads are hereby designated as All-Terrain Vehicle routes as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:

             

            (a) The Thornapple Grade:  beginning in Section 32, Township 37 North, Range 5 West, at the intersection of Old J Road, and traveling north and east through Townships 37 North, Range 4 West and 38 North,  Range 4 West to end at the intersection with County Road W.

 

            (b) Haystack Road:  beginning in Section 17, Township 37 North, Range 4 West at the intersection of Thornapple Grade and traveling south and east to end at the intersection with West Lane.

 

            (c) The Bissel Grade:  beginning in Section 28, Township 37 North, Range 5 West at the intersection with Thornapple Grade and running north and east to the end of the Town Road in Section 3, Township 37 North, Range 5 West.

           

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

I.  Purpose

            The purpose of this ordinance is to designate a portion of County Road W, located in the Town of Winter as an all-terrain vehicle trail to allow access to fuel, services and the Tuscobia Trail; and to regulate the operation of all-terrain vehicles on that trail. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Trail Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Trail

            The following portion of County Road W is hereby designated as All-Terrain Vehicle trail as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year: 

 

            Commencing from the intersection with Old 70  in the Southwest

            Quarter of the Southwest Quarter of  Section 4, Township 38 North,

            Range 5 West, traveling north on County Road W to the intersection

            with Crawford Street in Section 32/33, Township 39 North, Range 5

            West.

           

            All-terrain vehicle trail will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

 

 

IV.  Release of Liability

            The Town of Winter shall not be responsible for accidents and/or injuries incurred

while operating an all-terrain vehicle on any designated route or trail.

 

 

V.  Regulation

            The Town of Winter regulates the operation of all-terrain vehicles on designated routes and trails as follows:

           

            a.  All all-terrain vehicles shall be operated single file in the county road right of way, as far off the paved road surface as practical, as marked and signed.

 

            b.  All all-terrain vehicle operators shall observe and obey posted speed limits

            and shall slow the all-terrain vehicle to 10 mph or less when operating within

            150 feet of a residence.  The speed limit for ATVs traveling on designated

            routes and trails is 20 mph unless otherwise posted.

 

            c.   All all-terrain vehicle operators shall have their headlights and tail lights         turned   on at all times.

 

            d.  All all-terrain vehicle operators and riders under the age of 18 must wear a

            helmet.

 

            e.  This trail is for ATV travel during daylight hours only.

 

VI.  Enforcement 

                        This ordinance shall be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.

 

VII.  Penalties

                        Wisconsin State All-terrain vehicle penalties as found in s. 23.33(13)(a) WI Stats, are adopted by reference.

            The purpose of this ordinance is to designate the Town of Winter roads listed in Section III as all-terrain vehicle routes, and to regulate the operation of all-terrain vehicles on those routes. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Routes

            The following roads are hereby designated as All-Terrain Vehicle routes as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:

 

            a.  Keehn Road, from the intersection with Old 70 in Section 8, Township 38    North, Range 5 West, south to the end of the road.

           

            b.  Wiley Road, from the intersection with Old 70 in Sections 5 and 8, Township           38 North,  Range 5 West, west to the end of the road.

           

            All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

I.  Purpose

            The purpose of this ordinance is to designate the Town of Winter roads listed in Section III as all-terrain vehicle routes, and to regulate the operation of all-terrain vehicles on those routes. 

 

II.  Authority

            The Town of Winter Board of Supervisors has specific authority to adopt this All-Terrain Vehicle Route Ordinance under s. 23.33(8)(b) and (11), WI Stats.

 

III.  Designation of All-Terrain Vehicle Routes

            The following roads are hereby designated as All-Terrain Vehicle routes as authorized by s. 23.33(8)(b), WI Stats from May 1 to November 15 of each year:

 

            a.  Old J, from the Rusk/Sawyer County line north to the intersection with

            Old 70 in Section 18,    Township 38 North, Range 5 West.

           

            b.  Old 70, from the Ojibwa/Radisson/Winter Township line north and east

            to the intersection with County Road W in Section 4, Township 38 North,

            Range 5 West.

 

            c.   Hogsback Road, from the Meadowbrook/Winter Township line east to

            the intersection with Old J.

 

All-terrain vehicle routes will be clearly marked, with signs designating beginning and ending as well as other directional signs as needed.  Signage will be provided, installed and maintained by local ATV clubs and/or interested parties.  Roads that are not signed are understood to be closed to ATV traffic.

 

IV.  Release of Liability

            The Town of Winter shall not be responsible for accidents and/or injuries incurred

while operating an all-terrain vehicle on any designated route.

 

V.  Regulation

            The Town of Winter regulates the operation of all-terrain vehicles on designated routes as follows:

            a.  All all-terrain vehicle operators shall ride single file on the far right of the

            paved surface of the road.

 

            b.  All all-terrain vehicle operators shall observe and obey posted speed limits

            and shall slow the all-terrain vehicle to 10 mph or less when operating within

            150 feet of a residence.  The speed limit for ATVs traveling on designated

            routes is 20 mph unless otherwise posted.

 

            c.   All all-terrain vehicle operators shall have their headlights and tail lights         turned   on at all times.

 

            d.  All all-terrain vehicle operators and riders under the age of 18 must wear a

            helmet.

Ordinance 2009-2

 

An Ordinance Establishing Fire Protection Charges

 

 

WHEREAS, 1983 Wisconsin Act 532 authorizes Towns to charge property owners a portion or all of the costs of fire protection; and

 

WHEREAS, it is in the public interest of the Town of Winter to charge all or a portion of  the costs of such protection to owners of the property;

 

NOW THEREFORE,  the Town of Winter Board of Supervisors does ordain as follows: 

 

 

Section 1 – State Authority

 

            Pursuant to Section 60.55, 60.555, and 60.557 of Wisconsin Statutes, the Town of Winter, Sawyer County hereby establishes the following policy and procedure for the payment of all or a portion of fire costs incurred by Town of Winter property owners as a result of fire calls to their property.

 

Section 2 – Liability for Fire Protection Costs

 

            The owners of real property within the Town of Winter for which fire protection is provided shall be responsible for the costs of fire calls made to their property by the Winter Fire Department, or any department called out for mutual aid, based on the following schedule but not to exceed a total charge of $500:

 

            Primary Engine             First hour                                  $100 per hour or part of

                                                Second/subsequent hrs                 75 per hour or part of

 

            Pumper truck                First hour                                  $75 per hour or part of

                                                Second/subsequent hrs     $50 per hour or part of

 

            Tanker truck                 First hour                                  $60 per hour or part of

                                                Second/subsequent hrs     $40 per hour or part of

 

            Other fire department owned vehicles                $35 per hour

 

            Firemen                        First hour per man                    $20 per hour or part of

                                                Second/subsequent hrs      $15 per hour or part of

                                                Foam                                       $85 per gallon

Section 3 – Billing and Payment Procedure

 

            The costs of fire calls as outlined above shall be billed by the Town of Winter Clerk to the property owner and paid to the Town of Winter within 90 days of the date of the bill.  Failure to pay the bill within 60 days will result in interest being charged at the rate of 1% per month from the date of the bill.  Those bills remaining outstanding, including interest, for more than 90 days as of November 1 of any year, shall be reviewed by the Town of Winter Board of Supervisors and may be placed on the tax roll as a delinquent special charge pursuant to Section 66.60 of Wisconsin Statutes.

 

Section  4 – Severability of Provisions

 

            Should any section or provisions of this ordinance be declared invalid, such decisions shall not affect the validity of the remaining portions of this ordinance.

 

Section 5 – Effective Date 

 

            This ordinance shall take effect from date of  passage and posting as provided by law.
